BLISTR LEGAL, TERMS OF SERVICE, PRIVACY POLICY & ACCEPTABLE USE

These terms and policies apply to Blistr and the services available through blistr.ai and associated Blistr applications and services.

Blistr is operated by:

In these terms, “Blistr”, “we”, “us” and “our” mean Conway Enterprise Worldwide Pty Ltd trading as blstr.ai and operating the Blistr service.

“Customer”, “you” and “your” mean any person or organisation accessing or using Blistr, including a real estate agent, agency, listing service, property owner, FSBO/private seller, landlord, property manager, developer, business or individual.

“Output” or “Outputs” means images, video, plans, maps, copy, data, presentations, audio, marketing collateral and other material generated, processed or supplied through Blistr.

PART A — TERMS OF SERVICE

1. Acceptance of these Terms

By creating a Blistr account, submitting a property, purchasing a service, uploading content, accessing completed collateral, downloading an Output or otherwise using Blistr, you agree to these Terms of Service and our Privacy Policy.

If you use Blistr on behalf of a company, agency or other organisation, you confirm that you have authority to accept these Terms on its behalf.

Blistr may also require specific confirmations when:

  • an account is created;

  • a property is submitted;

  • an invoice arrangement is selected;

  • particular AI features are used; or

  • completed collateral is delivered or approved.

Electronic acceptance forms part of the agreement between you and Blistr.

2. What Blistr Does

Blistr is an AI-powered real estate marketing production platform.

Depending on the service or package selected, Blistr may produce or process:

  • AI-enhanced property images;

  • property listing images;

  • virtual styling;

  • twilight imagery;

  • alternative lighting treatments;

  • macro and close-up imagery;

  • listing videos;

  • social media videos;

  • agent digital presenters;

  • agent avatars;

  • voice narration;

  • authorised voice cloning;

  • floor plans;

  • site plans;

  • 3D floor-plan representations;

  • projections;

  • property maps;

  • amenity maps;

  • location information;

  • property descriptions;

  • listing copy;

  • marketing headlines;

  • comparable sales information;

  • market information;

  • digital collateral;

  • print collateral;

  • social media content; and

  • other property marketing assets.

Blistr combines artificial intelligence, automation and property-specific production systems.

Artificial intelligence and automated systems are not infallible and can occasionally produce errors.

3. FINAL CUSTOMER VERIFICATION REQUIRED

IMPORTANT — PLEASE READ

Blistr uses advanced AI and property-specific compliance systems, but artificial intelligence can occasionally make mistakes.

Before publishing, distributing, uploading or otherwise publicly using any Blistr-generated material, you must review it against the actual property, source imagery and known property information and satisfy yourself that it accurately and lawfully represents the listing.

This final review is the responsibility of the Customer using or publishing the material.

You must verify, where applicable:

  • architecture;

  • walls;

  • doors;

  • windows;

  • cabinetry;

  • fixed fixtures;

  • permanent structures;

  • room configuration;

  • floor layout;

  • landscaping;

  • fencing;

  • driveways;

  • vehicle access;

  • pools;

  • sheds;

  • outbuildings;

  • agricultural infrastructure;

  • land characteristics;

  • surrounding properties;

  • views;

  • furniture;

  • virtual staging;

  • lighting treatment;

  • property features;

  • inclusions and exclusions;

  • floor plans;

  • measurements;

  • site plans;

  • property boundaries;

  • addresses;

  • maps;

  • amenities;

  • listing descriptions;

  • property statistics;

  • comparable sales;

  • market information;

  • video;

  • digital presenter content;

  • agent information;

  • narration;

  • subtitles;

  • captions; and

  • other factual or visual marketing representations.

You must compare completed Outputs against the actual property, original source imagery and information known to you.

You must not publish, distribute or continue using an Output that you know, reasonably suspect, or reasonably should know materially misrepresents the property.

If you identify an error, you should request a correction or refrain from using the affected Output.

Where Blistr has provided completed collateral and given you a reasonable opportunity to review it, the decision to publish or distribute that collateral is made by you.

Publication or distribution of an Output indicates that you have undertaken the review required by these Terms.

This does not remove or limit any rights that cannot legally be excluded.

4. Architectural Compliance Engine

Blistr uses a proprietary Architectural Compliance Engine together with property-specific AI processing controls designed to reduce unintended changes to a property during AI processing.

These systems are designed to help preserve important physical elements of the source property, including:

  • walls;

  • doors;

  • windows;

  • cabinetry;

  • fixed structures;

  • permanent fixtures;

  • architectural layout;

  • room configuration; and

  • other significant architectural characteristics.

Blistr's process is designed specifically for real estate marketing rather than simply asking a general-purpose AI system to make a property look more attractive.

However, no AI or automated image-processing system can guarantee perfect interpretation of every source image.

An AI system may occasionally:

  • misinterpret an object;

  • alter a detail;

  • remove an object;

  • generate an unintended object;

  • change a texture or material;

  • misinterpret a reflection;

  • alter landscaping;

  • introduce a visual artefact; or

  • otherwise produce an unintended variation.

For this reason, final Customer verification remains mandatory.

5. Enhanced Property Images

Standard enhanced Blistr property imagery is intended to provide an accurate professional marketing representation of the property.

It should not be treated in the same way as a completely conceptual or fictional image.

Blistr may improve elements such as:

  • exposure;

  • colour balance;

  • image clarity;

  • perspective;

  • lens distortion;

  • shadows;

  • highlights;

  • presentation;

  • weather appearance;

  • sky appearance; and

  • overall image quality.

Customers must nevertheless inspect the final image before use.

6. Lighting Conditions

Blistr may analyse, improve, recreate or simulate lighting conditions for property marketing.

This can include:

  • daylight enhancement;

  • exposure correction;

  • shadow balancing;

  • interior illumination;

  • exterior lighting;

  • golden-hour treatment;

  • twilight imagery;

  • weather improvement; and

  • sky enhancement.

Blistr's lighting systems are designed to provide believable, property-specific lighting rather than applying identical generic lighting to every property.

Where available, processing may take into account characteristics of the property and source imagery when determining:

  • lighting direction;

  • lighting intensity;

  • room illumination;

  • exterior illumination; and

  • time-of-day treatment.

Enhanced or simulated lighting does not constitute a guarantee that a particular room, area or property will receive the same amount, direction or duration of natural light at a particular date, season or time.

The Customer must ensure that the completed imagery does not materially misrepresent the property.

7. Virtual Styling

Blistr may use listing-aware AI styling to digitally furnish or decorate a property image.

The styling process is designed to select a visual treatment appropriate to the individual listing rather than applying identical furniture to every property.

Virtual styling may include:

  • sofas;

  • beds;

  • dining tables;

  • chairs;

  • occasional tables;

  • rugs;

  • artwork;

  • lamps;

  • bedding;

  • outdoor furniture;

  • decorative items; and

  • other non-permanent furnishings.

Virtual furnishings and decorative items are digitally generated.

They may not be exactly to scale and may not reflect the property's actual contents.

Unless expressly stated otherwise, virtual furnishings displayed in a Blistr image are not included with the property.

The Customer is responsible for making any disclosure concerning virtual styling or digitally altered imagery required by:

  • applicable legislation;

  • their agency;

  • a listing platform;

  • a property portal;

  • applicable industry rules; or

  • their professional obligations.

8. Macro and Close-Up Images

Blistr may generate macro or close-up images as representative marketing cutaways based on fixtures, materials, surfaces or finishes visible within supplied property imagery.

These images are designed to represent the apparent material, finish or detail.

They may not reproduce the precise geometry, dimensions, scale or physical configuration of the original fixture or item.

Macro and close-up imagery must therefore be reviewed before publication.

9. Floor Plans, Site Plans and Measurements

Floor plans, site plans, 3D plans, projections, measurements and other spatial representations produced or processed through Blistr are intended for property marketing purposes.

Unless expressly stated otherwise, they are approximate.

They are not:

  • architectural drawings;

  • engineering drawings;

  • construction drawings;

  • certified surveys;

  • title plans;

  • cadastral surveys;

  • legal boundary determinations;

  • building plans; or

  • certified measurements.

You must independently verify any measurement, dimension, area or boundary where accuracy is material.

If you provide your own plan, you are responsible for:

  • having permission to use it;

  • confirming it relates to the correct property; and

  • checking its accuracy before publication.

10. Authority to Submit a Property

By submitting a property to Blistr, you confirm that you have any authority and permissions reasonably necessary to:

  • submit the property;

  • provide information concerning the property;

  • upload property images and other media;

  • supply plans and documents;

  • allow Blistr to process the material;

  • create marketing collateral relating to the property; and

  • use or distribute the resulting Outputs.

Where applicable, permissions may be required from a:

  • property owner;

  • seller;

  • landlord;

  • agency;

  • listing authority;

  • copyright owner;

  • presenter;

  • agent; or

  • other rights holder.

You are responsible for obtaining the necessary permissions.

11. Agent Avatars, Likeness and Voice

Blistr may create or use authorised:

  • digital presenters;

  • avatars;

  • digital likenesses;

  • synthetic speech;

  • voice clones; and

  • other representations of a person.

If you submit or authorise these materials, you confirm that you have all necessary rights and permissions to provide and use the relevant person's:

  • photographs;

  • image;

  • likeness;

  • name;

  • voice;

  • audio recordings;

  • video;

  • wardrobe references; and

  • other identity material.

You must not use Blistr to:

  • impersonate another person without authority;

  • create a fraudulent endorsement;

  • falsely represent another person's involvement;

  • unlawfully clone another person's voice; or

  • otherwise misuse another person's identity.

Where image, voice or other identity information is protected as personal or sensitive information under applicable privacy law, it will be handled in accordance with our Privacy Policy and applicable legislation.

12. Listing Copy

Blistr may generate:

  • property descriptions;

  • advertising copy;

  • headlines;

  • feature summaries;

  • social content; and

  • other written marketing material.

AI-generated copy can occasionally contain inaccurate assumptions, errors or omissions.

You must verify factual statements before publication.

Blistr should not be relied upon to determine:

  • legal title;

  • ownership;

  • easements;

  • zoning;

  • planning restrictions;

  • building compliance;

  • statutory disclosure requirements;

  • tax obligations;

  • conveyancing matters;

  • legal property descriptions; or

  • other matters requiring specialist professional advice.

13. Comparable Sales and Market Information

Blistr may provide comparable sales, recent sales, market information, property insights and other data.

This information may be sourced from:

  • government datasets;

  • public records;

  • licensed datasets;

  • third-party providers; or

  • other property data sources.

Data may occasionally:

  • be delayed;

  • be incomplete;

  • contain errors; or

  • not include the most recent transaction.

Comparable-sales and market information is provided for general informational and property-marketing purposes.

It does not constitute:

  • a professional property valuation;

  • financial advice;

  • investment advice;

  • legal advice; or

  • a guarantee of a property's future value or sale price.

You must independently verify material information before relying upon it.

14. Maps, Amenities and Location Information

Blistr may provide:

  • maps;

  • amenity locations;

  • property location information;

  • distances;

  • travel information; and

  • other geographical data.

This information may rely on third-party mapping or data providers.

Travel times, distances and amenity information may change and may be affected by:

  • route selection;

  • traffic;

  • access;

  • road changes;

  • third-party data; and

  • other factors.

Customers should verify material location information before publication.

15. Customer Content

“Customer Content” includes material supplied by you to Blistr, including:

  • photographs;

  • images;

  • video;

  • audio;

  • voice recordings;

  • property information;

  • plans;

  • documents;

  • scans;

  • logos;

  • branding;

  • agent information;

  • notes; and

  • other uploaded material.

You retain your rights in Customer Content.

You grant Blistr a non-exclusive licence to host, store, copy, process, modify, transmit and otherwise use Customer Content only to the extent reasonably necessary to:

  • provide the requested services;

  • generate requested Outputs;

  • operate Blistr;

  • provide support;

  • troubleshoot problems;

  • maintain functionality;

  • maintain security;

  • keep appropriate business records; and

  • comply with legal obligations.

This licence does not transfer ownership of your Customer Content to Blistr.

Blistr will not use Customer Content or property Outputs for public promotional purposes without appropriate authority or permission.

16. Rights to Customer Content

You warrant that you have the rights and permissions required to supply Customer Content.

You must not knowingly provide material that unlawfully infringes another person's:

  • copyright;

  • trade mark;

  • privacy;

  • contractual rights;

  • confidentiality;

  • image rights;

  • personality rights; or

  • other legal rights.

17. Blistr Intellectual Property

Blistr retains ownership of its proprietary intellectual property and technology, including where applicable:

  • software;

  • platform architecture;

  • interfaces;

  • workflows;

  • processing systems;

  • production systems;

  • Architectural Compliance Engine;

  • lighting systems;

  • styling systems;

  • algorithms;

  • AI orchestration;

  • prompts;

  • automation;

  • templates;

  • databases;

  • production methodologies;

  • business processes;

  • branding;

  • trade marks;

  • know-how;

  • confidential information;

  • trade secrets; and

  • underlying technology.

Use of Blistr does not transfer ownership of these systems to you.

Except where restriction is prohibited by law, you must not:

  • reverse engineer;

  • decompile;

  • systematically extract;

  • reproduce;

  • copy;

  • replicate;

  • scrape; or

  • attempt to recreate

Blistr's proprietary technology, systems or confidential methodologies.

18. Rights to Use Completed Outputs

Subject to full payment and compliance with these Terms, Blistr grants you the right to use the Outputs supplied to you for legitimate property marketing and related business purposes.

To the extent Blistr owns intellectual property rights in a completed Output, this licence is non-exclusive, worldwide and royalty-free for those purposes.

Some Outputs may contain AI-generated elements or rely on third-party technologies.

The legal treatment of AI-generated material differs between jurisdictions.

Blistr therefore does not guarantee that every AI-generated component is capable of copyright protection or exclusive ownership in every jurisdiction.

19. Prohibited Uses

You must not use Blistr to:

  • create fraudulent property listings;

  • deliberately misrepresent a property;

  • intentionally conceal a material property defect in a misleading manner;

  • falsely advertise features that do not exist;

  • create knowingly deceptive real estate advertising;

  • impersonate another person without authority;

  • unlawfully use another person's voice or likeness;

  • infringe copyright or intellectual property rights;

  • breach privacy rights;

  • upload malicious code;

  • interfere with Blistr systems;

  • gain unauthorised access to Blistr;

  • unlawfully reverse engineer Blistr;

  • commit fraud;

  • facilitate unlawful activity; or

  • otherwise use Blistr in breach of applicable law.

Blistr may suspend or terminate access where it reasonably believes the platform is being used unlawfully, fraudulently, abusively or in serious breach of these Terms.

20. Revisions and Reruns

Eligible Blistr Outputs may have a feedback, correction, revision or rerun process.

The number or type of included revisions depends on the service or package purchased.

You should clearly describe the issue or requested alteration.

Additional charges may apply where a request:

  • exceeds the included revision allowance;

  • substantially changes the original brief;

  • requires new input material;

  • requires additional creative work;

  • requests additional assets; or

  • falls outside the service purchased.

Where additional paid work is required, Blistr will communicate the applicable charge before undertaking that additional paid work.

Some Outputs may depend on other Outputs.

For example, if an image has already been incorporated into video, digital collateral or print collateral, changing that image may require related collateral to be regenerated.

21. Errors Identified After Publication

If you discover that a published Output contains a material error or materially misrepresents a property, you should promptly take reasonable steps to:

  1. remove or correct the affected advertising where possible;

  2. stop further distribution of the inaccurate material; and

  3. request a correction from Blistr where required.

You must not knowingly continue distributing material that materially misrepresents a property.

22. Property Advertising Obligations

Property advertising may be subject to consumer-protection, real-estate, advertising and other laws.

You remain responsible for your professional and legal responsibilities when publishing property advertising.

Blistr does not become the:

  • listing agent;

  • selling agent;

  • property manager;

  • conveyancer;

  • valuer;

  • surveyor; or

  • legal adviser

for a property merely by producing marketing collateral.

Where you are a licensed or regulated property professional, your professional, statutory and regulatory obligations remain your responsibility.

Where you are a private or FSBO seller, you remain responsible for ensuring your property advertising complies with laws applicable to you.

23. Pricing

Current pricing is displayed through the applicable:

  • Blistr website;

  • application;

  • checkout;

  • account interface;

  • quotation; or

  • order.

Blistr may use fixed regional pricing.

Prices may vary according to:

  • country;

  • currency;

  • package;

  • property type;

  • services selected;

  • listing-service arrangements; and

  • other authorised commercial arrangements.

The price displayed and accepted at checkout, stated in an accepted quotation or included on an applicable invoice is the price applying to that transaction.

Blistr may change pricing prospectively.

A later price change does not alter the price of an order already accepted unless agreed with you.

24. Payments and Invoices

Payment options available to you will be displayed at purchase.

Approved Australian Customers may be offered payment by card or invoice.

Where an invoice arrangement is approved, payment is due within 30 days of the invoice date unless another written arrangement applies.

International Customers will generally be required to pay by card through checkout unless otherwise agreed.

Applicable taxes, including GST, VAT or other taxes, will be treated as displayed on the relevant checkout, invoice or transaction documentation.

You are responsible for paying valid amounts when due.

25. Cancellations and Refunds

Cancellation and refund rights are subject to:

  • the stage of production;

  • the relevant service;

  • any terms disclosed at purchase; and

  • applicable law.

Blistr is not required to provide a refund merely because a Customer changes their mind where applicable law does not require one.

Nothing in this section affects any refund, remedy or other right available under the Australian Consumer Law or other law that cannot be excluded.

26. Turnaround Times

Blistr is designed for rapid production.

Any turnaround time displayed by Blistr is an estimate unless expressly guaranteed in writing.

Delivery can be affected by:

  • incomplete information;

  • unsuitable source images;

  • missing materials;

  • requested revisions;

  • unusually large properties;

  • rural or agricultural complexity;

  • technical failures;

  • internet outages;

  • third-party provider outages; and

  • circumstances outside Blistr's reasonable control.

Blistr will use reasonable efforts to provide services within applicable stated timeframes.

27. Third-Party Services

Blistr may rely upon third-party providers for services including:

  • cloud infrastructure;

  • artificial intelligence;

  • image processing;

  • video processing;

  • voice processing;

  • payments;

  • property data;

  • mapping;

  • analytics;

  • communications;

  • storage; and

  • other technology infrastructure.

Third-party services may occasionally:

  • experience outages;

  • change functionality;

  • become unavailable;

  • change their terms; or

  • discontinue a service.

Blistr does not control independent third-party platforms.

Where a third-party failure affects a Blistr service, Blistr will take reasonable steps to restore or provide the affected service where reasonably practicable.

28. Service Availability

Blistr does not guarantee uninterrupted availability.

Blistr may temporarily suspend or restrict functionality where reasonably necessary for:

  • maintenance;

  • upgrades;

  • security;

  • technical faults;

  • third-party outages;

  • emergencies; or

  • circumstances outside its reasonable control.

29. No Guarantee of Property Performance

Blistr provides marketing production services.

Blistr does not guarantee that using Blistr will:

  • sell a property;

  • lease a property;

  • increase a property's value;

  • increase its sale price;

  • obtain a particular sale price;

  • reduce days on market;

  • generate enquiries;

  • generate leads;

  • improve conversion;

  • achieve a particular buyer response; or

  • produce any particular commercial result.

Property performance depends on many matters outside Blistr's control.

30. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or any other law where doing so would be unlawful.

Where Australian Consumer Law permits liability for a failure to comply with a consumer guarantee relating to qualifying services not ordinarily acquired for personal, domestic or household use or consumption to be limited, Blistr may, where fair and reasonable, limit that liability to:

  • supplying the affected services again; or

  • paying the reasonable cost of having the affected services supplied again.

This section applies only to the extent permitted by law.

31. Limitation of Liability

Subject to section 30 and any liability that cannot lawfully be excluded or limited, to the maximum extent permitted by law Blistr is not liable for indirect, incidental, special or consequential losses such as loss of:

  • profit;

  • revenue;

  • business opportunity;

  • expected savings; or

  • goodwill.

To the extent permitted by law, Blistr is not responsible for loss arising from:

  • your failure to review an Output before publication;

  • knowingly publishing an Output after discovering a material error;

  • continuing to use an Output after identifying a material error;

  • inaccurate information supplied by you;

  • incomplete information supplied by you;

  • material submitted without required permission;

  • changes made to an Output after Blistr supplied it;

  • unlawful use of an Output;

  • misleading use of an Output;

  • failure by you to comply with professional or regulatory requirements; or

  • use of an Output for a purpose for which it was not intended.

Where liability may lawfully be limited, and where doing so is fair and reasonable, Blistr's aggregate liability arising from a particular order will not exceed the amount paid to Blistr for the particular service giving rise to the claim.

Nothing in these Terms excludes or limits liability where doing so would be unlawful.

32. Customer Indemnity

To the extent permitted by law, you indemnify Blistr against third-party claims and reasonable losses and costs arising directly from:

  • your unlawful use of an Output;

  • Customer Content supplied without necessary authority;

  • intellectual-property infringement caused by Customer Content;

  • unauthorised use of another person's identity, likeness or voice;

  • fraudulent information supplied by you;

  • knowingly publishing materially inaccurate material after identifying the error; or

  • your material breach of these Terms.

This indemnity does not apply to the extent the relevant loss was caused by:

  • Blistr's negligence;

  • Blistr's breach of these Terms; or

  • conduct for which liability cannot legally be excluded.

33. Accounts and Security

You are responsible for maintaining the security of your account and login credentials.

You must notify Blistr if you reasonably suspect:

  • unauthorised access;

  • stolen credentials;

  • fraudulent activity; or

  • another security issue affecting your account.

Blistr may temporarily suspend access where reasonably necessary to protect:

  • you;

  • other Customers;

  • Blistr;

  • Blistr systems; or

  • third parties.

34. Suspension and Termination

You may stop using Blistr at any time, subject to outstanding:

  • orders;

  • invoices;

  • payment obligations; and

  • other obligations that have already arisen.

Blistr may suspend or terminate access where you:

  • materially breach these Terms;

  • fail to pay a valid overdue amount;

  • unlawfully use Blistr;

  • create a material security risk;

  • engage in fraud;

  • repeatedly misuse the platform; or

  • knowingly use Outputs for materially misleading property advertising.

Where reasonably practicable and appropriate, Blistr will provide notice and an opportunity to remedy a breach before terminating an account.

35. Changes to These Terms

Blistr may update these Terms to reflect changes in:

  • services;

  • technology;

  • legislation;

  • regulatory requirements; or

  • business operations.

The current version will display its most recent update date.

Material changes will apply prospectively and notice will be provided where reasonably required by law.

An existing order will ordinarily remain subject to the terms applying when that order was accepted unless a change is required by law or separately agreed.

PART B — ACCEPTABLE USE POLICY

36. Responsible Use

Blistr is intended to be used for legitimate property marketing and related business purposes.

You must use Blistr responsibly and lawfully.

You must not use Blistr to intentionally:

  • create deceptive property advertising;

  • manufacture a property feature that does not exist and present it as real;

  • materially conceal a defect in a misleading way;

  • create a fake property listing;

  • steal or reproduce another person's listing without authority;

  • falsely represent ownership or authority over a property;

  • violate copyright;

  • misuse another person's image or voice;

  • harass another person;

  • commit fraud;

  • distribute malicious software;

  • compromise Blistr security;

  • bypass technical restrictions;

  • gain unauthorised system access; or

  • conduct unlawful activity.

37. Misrepresentation

Professional enhancement is different from material misrepresentation.

Blistr must not be intentionally used to create a false impression about a material characteristic of a property.

This applies to matters including:

  • structure;

  • permanent fixtures;

  • land;

  • views;

  • access;

  • dimensions;

  • location;

  • amenities;

  • building condition; and

  • other material characteristics.

38. Enforcement

Where Blistr reasonably believes an account or Output is being used for serious unlawful or deceptive activity, Blistr may:

  • refuse to process an instruction;

  • suspend affected functionality;

  • request additional information;

  • remove access to affected material; or

  • suspend or terminate an account.

Any action will be taken having regard to the circumstances and applicable law.

PART C — PRIVACY POLICY

39. Our Commitment to Privacy

Conway Enterprise Worldwide Pty Ltd recognises the importance of protecting personal information.

This Privacy Policy explains how Blistr may collect, hold, use, disclose and protect personal information.

We intend to manage personal information transparently and in accordance with privacy laws that apply to us.

Blistr may process an authorised person's image, likeness or voice to provide features such as:

  • agent avatars;

  • digital presenters;

  • synthetic narration;

  • voice cloning; and

  • related property marketing content.

Where such information constitutes sensitive, biometric or otherwise specially protected information under applicable law, Blistr will handle it in accordance with the requirements applying to that information.

Customers must not provide another person's image, likeness, voice or identity information unless they have the authority or consent required to do so.

42. How We Collect Information

We may collect information:

  • directly from you;

  • when you create an account;

  • when you use Blistr;

  • when you submit a property;

  • when you upload media;

  • during checkout;

  • when an invoice is issued;

  • when you contact support;

  • when you submit feedback;

  • through website or application technologies;

  • through authorised integrations;

  • from service providers;

  • from public or commercial property-data sources where lawful; and

  • from another person or organisation authorised to provide information to us.

  • generate property Outputs;

  • create authorised digital presenters;

  • generate authorised voice content;

  • maintain service functionality;

  • cloud infrastructure providers;

  • AI service providers;

  • video-processing providers;

  • voice-processing providers;

  • mapping providers;

  • property-data providers;

  • payment processors;

  • analytics providers;

  • communications providers;

  • professional advisers;

  • insurers;

  • regulators;

  • law enforcement; or

  • other parties where authorised or required by law.

We do not provide third parties with permission to use Customer information for unrelated purposes merely because they process information on our behalf.

45. AI and Automated Processing

Blistr uses artificial intelligence and automated processing as an integral part of its service.

Customer Content may be processed by automated systems for purposes such as:

  • image enhancement;

  • virtual styling;

  • architectural consistency;

  • lighting treatment;

  • video production;

  • voice generation;

  • listing-copy generation;

  • data analysis;

  • mapping;

  • floor-plan processing; and

  • marketing-collateral production.

We may combine automated processing with rules, workflows and human or Customer review.

Final property-marketing publication decisions remain with the Customer.

46. Overseas Processing

Blistr operates online and may use cloud, AI, data and technology providers that process or store information outside Australia.

The location of processing may vary according to:

  • the provider;

  • service being used;

  • technical infrastructure;

  • Customer location; and

  • availability.

Where applicable law requires Blistr to identify likely overseas recipients or processing locations, Blistr will take reasonable steps to provide that information where practicable, including through this Policy, a collection notice or other service documentation.

Customers acknowledge that privacy and data-protection laws differ between jurisdictions.

Where cross-border privacy requirements apply to Blistr, we will take reasonable steps to comply with them.

47. International Privacy Rights

Depending on where you are located and the privacy law applicable to Blistr, you may have rights concerning your personal information.

These may include rights to:

  • request access;

  • request correction;

  • request deletion;

  • object to particular processing;

  • request restriction of processing;

  • withdraw consent where processing is based on consent;

  • request information about processing; or

  • make a privacy complaint.

These rights are not identical in every jurisdiction and may be subject to legal exceptions.

Blistr will respond to valid privacy requests as required by applicable law.

You may request access to personal information Blistr holds about you or ask us to correct information that is inaccurate, out of date, incomplete or misleading.

We may need to verify your identity before processing a request.

49. Deletion Requests

You may request deletion of personal information where applicable.

Deletion of some information may also affect our ability to continue providing particular Blistr services.

Blistr retains personal information and Customer Content only for as long as reasonably necessary for purposes including:

  • providing services;

  • account administration;

  • property production;

  • customer support;

  • security;

  • billing;

  • legal compliance;

  • financial recordkeeping;

  • fraud prevention;

  • dispute resolution; and

  • legitimate business recordkeeping.

Different categories of information may have different retention periods.

When information is no longer reasonably required, Blistr will take reasonable steps to delete, destroy or de-identify it where required by applicable law.

51. Data Security

Blistr takes reasonable technical and organisational measures intended to protect information from:

  • unauthorised access;

  • misuse;

  • interference;

  • loss;

  • alteration;

  • destruction; and

  • unauthorised disclosure.

No internet-based service, electronic transmission or storage system can guarantee absolute security.

Customers are responsible for keeping their account credentials secure.

52. Data Breaches

Where Blistr is subject to applicable data-breach notification requirements, including the Australian Notifiable Data Breaches scheme where applicable, Blistr will assess and respond to suspected eligible data breaches as required by law.

Where notification is legally required, affected individuals and relevant authorities will be notified in accordance with applicable requirements.

53. Payment Information

Payments may be processed using third-party payment services.

Where payment-card information is entered directly into a third-party payment provider's systems, Blistr may not receive or store the complete card number.

Payment providers operate under their own security, legal and privacy obligations.

54. Direct Marketing

Blistr may send service-related communications necessary to:

  • administer your account;

  • process orders;

  • deliver Outputs;

  • provide security notices;

  • issue invoices;

  • provide support; and

  • communicate important service information.

Marketing communications will be sent where permitted by applicable law.

Where required, Blistr will obtain consent before sending commercial electronic marketing communications.

Marketing messages will provide an appropriate method of unsubscribing.

Choosing not to receive marketing communications will not prevent Blistr from sending essential account, transactional, security or service communications.

If you believe Blistr has mishandled your personal information, please contact Blistr first so that we can investigate the issue.

60. No Professional Advice

Unless expressly stated otherwise, Blistr provides technology and property-marketing services.

Blistr does not provide:

  • legal advice;

  • conveyancing advice;

  • surveying advice;

  • engineering advice;

  • architectural advice;

  • tax advice;

  • financial advice; or

  • formal property valuations.

You should seek appropriately qualified professional advice where required.

61. Disputes

If a dispute arises concerning Blistr, the parties should first attempt in good faith to resolve the matter directly.

Nothing in this section prevents either party from:

  • exercising statutory rights;

  • obtaining urgent court relief;

  • contacting a regulator; or

  • pursuing another remedy available under applicable law.

62. Governing Law

These Terms are governed by the laws of Victoria, Australia.

Subject to any mandatory right allowing proceedings to be brought elsewhere, the parties submit to the jurisdiction of the courts of Victoria and courts entitled to hear appeals from those courts.

63. Severability

If a provision of these Terms is found to be invalid, unlawful or unenforceable, it will be read down to the minimum extent necessary where possible.

If it cannot be read down, that provision will be severed.

The remainder of these Terms will continue to operate.

64. No Waiver

A failure by Blistr to immediately exercise a right under these Terms does not constitute a waiver of that right.

65. Entire Agreement

These Terms, together with the applicable:

  • Privacy Policy;

  • Acceptable Use Policy;

  • order;

  • package description;

  • quotation;

  • checkout information;

  • account confirmation;

  • Listing Submission Confirmation; and

  • any other document expressly incorporated into the agreement,

form the agreement between Blistr and the Customer concerning the relevant services.

66. Updates to this Legal Page

Blistr may update this legal page from time to time.

Updates may be made to reflect changes in:

  • Blistr services;

  • technology;

  • legislation;

  • regulatory requirements;

  • privacy requirements; or

  • business practices.

The most recent revision date will be displayed at the top of this page.

Where required by applicable law, Blistr will provide appropriate notice of material changes.

IMPORTANT CUSTOMER ACKNOWLEDGEMENT

AI AND AUTOMATED SYSTEMS CAN MAKE MISTAKES.

Blistr uses property-specific technology including architectural compliance, lighting and styling systems designed to improve the quality and accuracy of property marketing.

However, the Customer remains responsible for conducting a final review before publication.

By publishing or distributing a Blistr Output, you confirm that you have had an opportunity to review the material and are responsible for ensuring that it accurately and lawfully represents the property.

If you identify a material error, do not publish the affected Output until it has been corrected, replaced or removed.
